Diversion and Court Support - Mental Health
The CMHA Waterloo Wellington Mental Health & Justice Team (MHJ) provides recovery oriented, community-based support to people who are involved in the criminal justice system and live with mental health/substance use health issues/concurrent issues. This team will support people in the Criminal Justice System by ensuring support is well matched to their needs, goals and stage of recovery.
Services are offered to all of Wellington County. The team is made up of 3 support coordinators, clinician/counselor, Indigenous support worker, and intake coordinator.
For individuals 18 or older with a mental health issue, substance use health issue or a concurrent issue substantially connected to the offence they are charged with, they can be considered for the program. Entrance into the Wellness Stream or Wellness Diversion Stream require the agreement of the Crown and accused person. Entrance into these streams occurs through the following steps:
A referral, which may be made by any person;
The referral, while it can be made to the court, will typically be to a particular stream within the court;
A review by the Federal and/or Provincial Crown of the referral. The Crown will indicate whether it agrees the person should be accepted into the program, and will provide details of current resolution positions, and the anticipated resolution upon successful completion of the program;
A review with the accused by their counsel, or duty counsel, or for self-represented accused, the case coordinator, of the requirements of the program.
